“Certainly Trisha,” says Bliss. “Filing a petition for probate is essentially the first formal step in initiating the legal process of settling a deceased person’s estate. This involves submitting specific documents to the court, such as Form DE-111, which formally requests the appointment of an executor or administrator to handle the estate’s affairs.”

Bliss continues, “The petition outlines key information about the deceased individual, their assets, and any existing will. It also formally notifies the court that probate proceedings are necessary. Without this crucial step, the legal process for distributing assets and settling debts cannot begin.”

Potential Challenges During Petition Filing

“Now, Steve, I imagine there can be occasional challenges during this stage. Have you encountered any common issues while assisting clients with filing petitions?”

Bliss nods thoughtfully. “It’s not uncommon for families to face unexpected hurdles during the petition filing process. Sometimes, locating all necessary documentation, such as a valid will or updated asset records, can prove challenging, especially if the deceased individual wasn’t meticulous about record-keeping.

Conversely, disputes may arise among family members regarding the executor’s appointment or the interpretation of the will’s provisions. I recall one instance where siblings disagreed over who should be named as executor. We were able to mediate a solution that satisfied all parties involved while upholding the deceased individual’s wishes.”
