You’re welcome! It’s my pleasure to be here and discuss this crucial topic. Trusts are essential tools in estate planning because they allow individuals to control how their assets are distributed after they pass away. Consequently, they can help avoid the costly and time-consuming process of probate.
Moreover, trusts offer a level of privacy that wills lack, as the terms of the trust aren’t part of public record. This can be important for individuals who want to keep their financial affairs confidential.
Choosing the Right Trust
Now, there are various types of trusts. How do you guide your clients in choosing the right one?
I always start by asking my clients about their goals and concerns. For instance, are they looking to minimize estate taxes? Do they have beneficiaries with special needs? Are they concerned about protecting their assets from potential creditors? Understanding these factors helps me recommend the most suitable trust structure.
Let’s take the example of a Revocable Living Trust, which is one of the most common types. It offers flexibility because the grantor can make changes during their lifetime.
It also avoids probate and maintains privacy. Nevertheless, it’s important to note that upon the grantor’s death, the trust becomes irrevocable.
Conversely, an Irrevocable Trust provides more robust asset protection but comes with less flexibility. The grantor relinquishes control over the assets placed in the trust. This type is often used for advanced estate planning strategies, such as minimizing estate taxes or protecting assets from potential lawsuits.
Challenges and Solutions
Have you encountered any common challenges when setting up these trusts? Can you share an example?
One situation I recall involved a family business. The client was concerned about ensuring the continuity of the business after their passing, while also providing for their children. We opted for a combination approach using both a Revocable Living Trust and a testamentary trust.
This allowed the business to continue operating smoothly, with provisions for transferring ownership to the next generation. The testamentary trust ensured that the children would receive their inheritance gradually, minimizing the risk of them squandering it.
I remember the client expressing immense relief knowing that both their business and their family’s future were protected. It’s moments like these that remind me why I do what I do.

That’s a powerful example, Steve. To further illustrate the importance of trusts, according to the American Bar Association, approximately 60% of Americans don’t have a will or trust in place.
This can lead to complications and unintended consequences for their loved ones after they pass away.
What advice would you give to viewers who are considering setting up a trust?
