Good evening, Temecula, and welcome back to our segment on legal matters that affect you directly. I’m Tammy Jones, your local news reporter, here tonight with Steve Bliss, a respected trust attorney serving the Temecula Valley. Steve, thanks for joining us.
Welcome to Our Show
Thank you, Tammy. It’s always a pleasure to discuss estate planning and how trusts can protect families.
What Type of Trusts Do You Typically Recommend?
Tammy, the type of trust I recommend depends entirely on the individual client’s needs and goals. However, a very common and beneficial type is the Revocable Living Trust.
The Benefits of a Revocable Living Trust
A Revocable Living Trust allows individuals to maintain control over their assets during their lifetime while avoiding the lengthy and often costly probate process after they pass away. Moreover, these trusts provide a level of privacy that wills do not offer, as the terms are not made public record.
Ordinarily, the grantor (the person creating the trust) can modify or dissolve the trust at any time before their death. Consequently, it offers flexibility to adapt to changing life circumstances. Upon the grantor’s passing, the trust becomes irrevocable, and assets are distributed according to the grantor’s wishes.
The benefits of a Revocable Living Trust are numerous. According to a recent study by the American Bar Association, over 50% of Americans aged 55 and older have utilized trusts for estate planning purposes (Source: American Bar Association).
Have You Encountered Any Challenges Implementing Revocable Living Trusts?
While Revocable Living Trusts are generally straightforward to establish, I have encountered situations where clients initially hesitate due to a misunderstanding of how they function. For instance, one client was concerned that creating a trust meant relinquishing all control over their assets.
Understanding the Trust Process
I patiently explained that as the grantor, they would retain full control and access to their assets while alive. The trust simply acts as a framework for managing and distributing those assets after their passing, ensuring their wishes are honored and minimizing potential family conflicts.
Another time, I worked with a family who had experienced significant loss. They were hesitant to move forward with any legal planning. But once they understood how a Revocable Living Trust could protect their children’s inheritance and provide for their future needs, they felt a sense of relief and empowerment.
What Advice Would You Give to Our Viewers Regarding Estate Planning?
My advice is simple: don’t wait. Estate planning is not just for the wealthy; it’s essential for everyone who wants to protect their loved ones and ensure their assets are distributed according to their wishes. A Revocable Living Trust can be a powerful tool for achieving those goals.
