I’m here today with Ted Cook, a compassionate elder protection attorney serving the San Diego area from his firm Point Loma Estate Planning APC. Ted, thanks for taking the time to chat with me.
What Inspired You To Focus On Elder Protection Law?
It’s a real privilege to be here. I truly believe in advocating for our senior population, they are often vulnerable and need someone looking out for their best interests. My passion stems from seeing firsthand the challenges seniors face – financial exploitation, abuse, neglect. It’s heartbreaking. I wanted to use my legal skills to empower them and ensure their safety and well-being.
Let’s Talk About The Elder Protection Process: Can You Give Us A Snapshot?
Absolutely! Protecting seniors is a multi-step process. Think of it like building a shield around them. First, we have the initial engagement where I meet with the client and their family to understand their situation. We assess any potential risks they might be facing – financial abuse, physical neglect, or even emotional manipulation. From there, we move into case assessment: identifying the legal issues, gathering evidence, and evaluating the urgency of the situation.

I’m Curious About “Protective Actions”: Can You Explain That Step In More Detail?
This stage is all about immediate action. We need to put safeguards in place to protect the senior from further harm. Sometimes, this involves seeking a restraining order against an abuser. Other times, we might contact Adult Protective Services (APS) or petition for guardianship or conservatorship if the individual lacks capacity to make decisions for themselves.
“Ted helped my mother when she was being financially exploited by a caregiver. He was so patient and understanding, explaining everything in simple terms. I don’t know what we would have done without him.” – Sarah M., La Jolla
We also focus on financial protection – freezing accounts to prevent further theft, revoking power of attorney if necessary, or even preventing unauthorized transfers of property. It’s a critical step in stopping the bleeding and giving the senior a chance to recover.
“I was so worried about my father who was suffering from dementia. Ted helped us navigate the legal complexities of setting up a conservatorship. He truly cared about my dad’s well-being.” – John D., Point Loma
“Ted’s knowledge and compassion made a difficult situation bearable. He fought tirelessly for my rights and ensured I was protected from further abuse.” – Mary B., Coronado
I recall one instance where a client was being pressured to sign over their home to a family member. They were already experiencing cognitive decline, making them vulnerable to manipulation. We stepped in, obtained a temporary restraining order against the family member, and ultimately helped the client maintain ownership of their property.
Are There Any Common Challenges With Taking “Protective Actions”?
Absolutely. Sometimes, family members can be resistant to our intervention, believing they know what’s best for their loved one. We always strive for open communication and collaboration, but in some cases, legal action might be necessary to override those objections. Another challenge is proving abuse or neglect. Gathering evidence can be tricky, especially if the senior is hesitant to speak up due to fear or embarrassment.
