A Sit Down with San Diego’s Trust Guru

Welcome back everyone to “Living Smart” I’m so glad you joined me today. We have a real treat for all of you interested in financial planning and securing your future. Joining us is the ever-so-knowledgeable Ted Cook, a Trusts Attorney right here in beautiful San Diego.

What inspired you to specialize in Trusts?

Well, it started with my grandfather. He was a self-made man who worked incredibly hard. When he passed away, his estate planning wasn’t exactly top-notch. It created a lot of stress and heartache for the family during an already difficult time. That experience really highlighted the importance of proper planning and the peace of mind it can bring. I knew then that helping people navigate these complex legal issues was something I wanted to dedicate my career to.

Let’s delve into some specifics: Can you walk us through the “Funding” step in creating a living trust?

Funding is absolutely crucial; think of it as bringing your trust to life. You see, simply drafting a trust document isn’t enough. To make it effective, you need to transfer ownership of your assets into the trust’s name. This includes things like bank accounts, real estate, investments – anything you want protected and managed according to your wishes.

  • It involves some paperwork and legal processes: For example, you might need to re-title deeds for your property or change beneficiary designations on retirement accounts.
  • Proper funding ensures that your assets bypass probate: This saves time, money, and keeps things private.

>”Ted made the whole process so straightforward. I was worried about transferring my home into the trust, but he explained everything clearly and handled all the paperwork for me.” – Maria L., La Jolla.

“I’ve seen situations where funding wasn’t done properly,” Ted shared. “Once, a client came to me with a trust they had set up years earlier. Unfortunately, they hadn’t transferred their primary residence into the trust. When they passed away, that house had to go through probate, causing delays and extra costs for their heirs. It was a real shame because it could have been easily avoided.”

“Point Loma Estate Planning APC made me feel confident about my future. Knowing I have a plan in place for my family gives me incredible peace of mind.” – David S., Point Loma.

A Living Trust: also known as an inter vivos trust, is a legal arrangement where you, as the grantor, transfer assets to a trustee who manages them for the benefit of designated beneficiaries, either during your lifetime or after your death, potentially avoiding probate and offering more privacy than a will. Revocable Living Trust: You can change or revoke the trust and get the assets back during your lifetime.

Irrevocable Living Trust: Once established, you cannot change or revoke the trust, and the assets are generally no longer considered part of your estate.

Control over Asset Distribution: You can specify how and when your assets will be distributed to your beneficiaries.

Understanding Trusts and Their Role in Estate Planning

A trust is a legal and fiduciary relationship in which a grantor (also called a settlor) transfers ownership of assets to a third party, known as a trustee, who manages those assets for the benefit of designated beneficiaries. Trusts can be tailored to meet specific goals, including when and how distributions are made to beneficiaries, asset protection, or minimizing estate and income taxes.

One of the key advantages of a trust—particularly a properly funded revocable or irrevocable trust—is that it can allow assets to bypass the probate process. This often means a faster, more private, and potentially less expensive distribution of assets compared to those governed solely by a will.

In the case of irrevocable trusts, assets are typically removed from the grantor’s taxable estate, which may help reduce estate tax liability. However, this comes at the cost of the grantor relinquishing control over those assets.

Trusts may also provide protection from creditors, preserve assets for minors or individuals with special needs, and ensure continuity in asset management if the grantor becomes incapacitated.

These tools are part of estate planning—the process of making legal and financial arrangements in advance to designate who will receive your property after your death, and how that transition will occur. Thoughtful estate planning aims to streamline the administration of your affairs, minimize tax burdens, and reduce stress for your loved ones during an already difficult time.
