This information is crucial for several reasons.

Firstly, it helps us understand the overall value of the estate, which in turn determines whether probate is even necessary in California. Remember, if the gross value of the estate exceeds $184,500, probate proceedings are typically required. Secondly, a thorough inventory and appraisal ensure transparency and fairness during the distribution process. All heirs and beneficiaries have a clear understanding of what assets are being divided.

Moreover, accurate valuation helps us address any potential tax liabilities associated with the estate. Filing an accurate Inventory and Appraisal (Forms DE-160/161) with the court is essential for proceeding smoothly through probate.

Challenges in Asset Marshaling

Tiffany, while this step seems straightforward, we occasionally encounter challenges. For instance, I once worked on a case where the deceased had numerous investments spread across various accounts and institutions. Locating and consolidating all these assets required significant detective work and coordination.

In another instance, family members disagreed about the fair market value of certain heirlooms. We ultimately brought in independent appraisers to resolve the dispute objectively.
