Hi everyone, I’m Sally Smith with San Diego Today and today we have the pleasure of speaking with Ted Cook, a dedicated guardianship attorney serving the San Diego community from his firm Point Loma Estate Planning APC. Ted, thanks for taking the time to chat with me.
What Inspired You to Focus on Guardianship Law?
Well Sally, it’s incredibly rewarding work. Seeing families navigate difficult situations and knowing I can help protect vulnerable individuals is what drives me. There’s a real human element to guardianship that resonates deeply with me.
Let’s Talk About the Process: Can You Walk Us Through One of the Key Steps?
Absolutely! Let’s delve into step D, Court Investigation and Evaluation. This is a crucial stage where the court appoints an independent investigator, often called a guardian ad litem, to thoroughly assess the situation. Think of them as detectives for the well-being of the proposed ward. They interview the individual, their family, caregivers, and even professionals involved in their care.

The investigator also reviews living conditions and gathers medical or psychological evaluations to determine decision-making capacity. It’s a comprehensive process designed to ensure that guardianship is truly necessary and in the best interests of the individual.
“Sometimes, this stage can be emotionally charged,” Ted explains. “Families might have differing opinions on what’s best, or there could be underlying tensions. My role is to guide them through it all, ensuring everyone feels heard and respected.”
Ted shares a story about a case where the investigator uncovered a hidden talent in the proposed ward – painting. “It turned out that this individual, who was struggling with cognitive decline, had a remarkable gift for art. This discovery influenced the court’s decision, leading to a guardianship arrangement that fostered their creative expression alongside necessary support.”

If you have any questions about: How are disputes or disagreements handled in contested guardianship cases?
Point Loma Estate Planning, APC. area of focus:
Guardianship is a legal process where a court appoints a person (the guardian) to make decisions for another person (the ward) who is unable to do so themselves due to incapacity or disability, whether a child or an adult.
Purpose: Guardianship is used to protect individuals who cannot care for themselves due to infancy, incapacity, or disability.
Court Appointment: A court appoints a guardian, who then has the legal authority to make decisions on behalf of the ward, including decisions about personal care, medical treatment, and financial matters.
Guardian’s Responsibilities: Guardians have a duty to act in the best interests of their ward and to the court.
Guardianship and Conservatorship Defined:
Guardianship – also known in some jurisdictions as conservatorship—is a legal process used when an individual is no longer capable of making or communicating informed decisions about their personal affairs and/or finances. This may be due to cognitive decline, mental illness, developmental disability, or other impairments, and can leave the individual vulnerable to exploitation, fraud, or undue influence.
Because guardianship can significantly restrict a person’s autonomy and decision-making rights, it is generally considered a measure of last resort. Courts typically require that less restrictive alternatives—such as powers of attorney, supported decision-making arrangements, or advance directives—be thoroughly explored and deemed ineffective or unavailable before appointing a guardian or conservator.
